RD Buenafe awards Medalya ng Kagalingan to Masbate cops

LEGASPI CITY 4/22/17 (BICOL STANDARDA) — Bicol Police Regional Director Chief Supt. Melvin Ramon Buenafe and Masbate PNP Director P/SSupt. Froilan Elopre has awarded the seven (7) police officers of Uson, Masbate the Medalya ng Kagalingan after they survived an ambush and a twenty-minute gunfight with the members of the New People’s Army yesterday.

The incident occurred at Barangay Badling, Uson, Masbate, yesterday, 4 a.m.

The recognition ceremony was held at Camp Bonny Serrano in Masbate City.

Meanwhile, Buenafe had personally visited PO1 Chileto Amistad who was wounded in the said incident when he was hit by bomb fragments from an improvised explosive, allegedly planted by the rebels.

Amistad was also given the Wounded PNP Personnel Medal and financial assistance from the regional director, as well as from Governor Antonio Kho of Masbate Province.

Buenafe also ordered that a two-day Improvised Explosive Decive (IED) Identification and Awareness Course be immediately conducted so that all police personnel will be aware of this security threats.

It will be recalled that for the past few weeks the NPA rebels in Masbate has been very active, the latest of which was this incident where Amistad was wounded.

Rural Bank of Ragay closed

The Monetary Board (MB) of the Bangko Sentral ng Pilipinas (BSP) prohibited Rural Bank of Ragay (Camarines Sur), Inc. from doing business in the Philippines. Under Resolution No. 635.B dated April 20, 2017, the MB directed the Philippine Deposit Insurance Corporation (PDIC) as Receiver to proceed with the takeover and liquidation of the bank. PDIC took over the bank on April 21, 2017.

Rural Bank of Ragay is a two-unit rural bank with Head Office located at Tomas Delgado St. cor. Provincial Road, Poblacion Ilaod, Ragay, Camarines Sur. Its lone branch is located in Del Gallego, Camarines Sur. Based on the General Information Sheet filed by the bank with the Securities and Exchange Commission as of June 30, 2016, Rural Bank of Ragay is owned by Linda C. Aquino (18.87%), Jaime A. Manubay (11.61%), Mildred A. Perez (10.45%), Kristoffer Lloyd C. Aquino (6.68%), Emma Louisa C. Aquino (5.80%), Maika C. Aquino (5.80%), Charina A. Lonogan (5.25%), Rolando M. Carandang (4.13%), Theresita B. Aquino (3.30%), Guillermo E. Abogado (3.18%), and Ruben D. Literal (2.35%). The Bank’s Chairman and President is Emma Louisa C. Aquino.

Latest available records show that as of December 31, 2016, Rural Bank of Ragay had 8,062 deposit accounts with total deposit liabilities of PHP178.5 million. Total insured deposits amounted to PHP172.9 million equivalent to 96.8% of total deposits.

PDIC assured depositors that all valid deposits and claims shall be paid up to the maximum deposit insurance coverage of PHP500,000.00. Depositors with valid deposit accounts with balances of PHP100,000.00 and below shall be eligible for early payment and need not file deposit insurance claims, except accounts maintained by business entities, or when they have outstanding obligations with Rural Bank of Ragay or acted as co-makers of these obligations. Depositors have to ensure that they have complete and updated addresses with the bank. They may update their addresses until May 2, 2017 using the Mailing Address Update Forms to be distributed by PDIC representatives at the bank premises.

Ombudsman Morales sacks Mayor Gaite

BAAO, Camarines Sur 4/21/17 (BICOL STANDARD) Ombudsman Conchita Carpio-Morales has ordered the dismissal of town mayor Melquiades Gaite from office, due to the allegedly anomalous lease contract agreement for the lease of the public market.

Morales also approved the findings of Graft Investigation and Prosecution Officer Maricel Quilates against Gaite for grave misconduct and conduct prejudicial to the best interest of the service.

Also, his civil service eligibility was cancelled.

The Ombudsman’s order stemmed from the complaint filed by municipal councilor Dante Bismonte. The complainant said Gaite acted beyond his authority when he entered into a contract of lease with Lamvert Consolidated Complex Inc. (LCC) covering a 1,704 square meter area of the town’s public market for 25 years.

It was pointed out that under the Revised Market Code, the period for lease agreement is for five years only.

Meanwhile, Bismonte said that Gaite should have sought an authorization of the Sangguniang Bayan to enter into such contract. He cited the opinion of the Department of Interior and Local Government which stated that “separate authority to enter into a contract with the management of LCC for 25 years is necessary.”

Morales did not believe the argument of Gaite, who claims that the “absence of prior authorization was cured by the eventual ratification of the Sangguniang Bayan.”

The Ombudsman affirmed that Gaite committed a corrupt act when he did not enforce the provision “goodwill money” pursuant to the ordinance, thus affording LCC unwarranted benefits.

BICOL STANDARD has not yet reached Gaite for his comments.

BM Gache: Sanitary landfill urgent in Cam Norte

DAET, CNorte--A privilege speech was delivered yesterday by Board Member Pol Gache taking notice of the impending closure of all open dumpsites, pursuant to the provisions of R.A. 9003.

Gache, a longtime provincial legislator and former town chief executive, said he got reliable information that the Environment Management Bureau in Region V is determined to enforce the law that prohibits the operation of open dumpsites.

Interpellated by his fellow Board Members, he said what could be considered as a provincial dumpsite is an area at Barangay Binatagan, Basud, Camarines Norte.

It will be recalled that last January, the town of Daet was ordered by the EMB to close the open dumpsite at Barangay Bibirao.

"Until now, however, the LGU could not comply for various reasons," Gache said.

BICOL STANDARD's source said that on November 10, 2016 Mayor Benito S. Ochoa received a letter from Regional Director Eva S. Ocfemia of the Department of Environment and Natural Resources (DENR) which treated the issue of the open dump site.

In the said letter Director Ocfemia said “Our Basura Patroller conducted an inspection at your disposal facility located at Barangay Bibirao, Daet on September 20, 2016. But said facility is still operating an open dumpsite. Please be informed that it is no longer allowed under R.A. 9003, or the Ecological Solid Waste Management Act of 2002."

Meanwhile, Board Member Gache also took notice of the information that LGU Daet has spent no less than Php 20 million for their material recovery project, yet the project remains idle and not operational.

Antecedent to this, Gov. Egay Tallado had already called for an inter-agency meeting last March 20 to discuss the issue regarding solid waste management.

In said meeting, a consensus that the provincial government should consider putting up a provincial sanitary landfill project was reached.

"Ako ay nangangamba na isang araw, magigising tayo na kalat ang basura sa tapat ng ating bahay o lansangan," Gache said.

"Hindi lang po ang Daet ang may problema ngunit lahat ng bayan sa ating lalawigan," he added.

Bicol bemedaled cop removed from rolls?

NAGA CITY—Whatever happened to Roger Dy, Jr., the bemedalled Bicolano police officer who hails from Libmanan, Camarines Sur remained a mystery, until today.

In an interview, Roger Dy Jr., who now claims the rank of Police Director General (PDG), said he earned his rank via Special Promotions after he was awarded at least 20 Medals of Valor.

Official police records, however, show that he (Dy, Jr.) has been dismissed from service due to Serious Neglect of Duty, based on an order dated May 6, 2016.

Even before the said order of dismissal his salary had been withheld starting December 2014.

At present, his name has been dropped from the rolls of the Philippine National Police.

Regarding said dismissal order, he told the BICOL STANDARD that he has a pending motion for reconsideration.

“I am confident that if I am accorded a fair hearing of my case, the dismissal order could be reversed. I believe that there is no legal basis for the order of dismissal. It is very unjust and patently illegal,” he said


The controversy started when Dy Jr., was designated as Regional Director of Region VIII, where he did not abide.

Dy Jr., said his dismissal was prompted when he failed to report to Region VIII, when he was designated as the PNP Regional Director of the said place.

He said that the position for he is assigned, which is Regional Director is for officers with a rank of Chief Superintendent. Hence, he is overqualified, pursuant to PNP standards.

“I now have the rank of Police Director General. If there was such an order for me to assume as PNP Regional Director, the same would no longer be applicable to me because of the present rank that I have,” he said.

Further, Dy Jr., narrated that the basis for the claim that his rank is Police Director General is a letter that then DILG Sec. Jesse Robredo sent to him.

The said letter, he said, was issued pursuant to Sec. 33 (b) of Republic Act 8551 on Special promotions for recipients of Medals of Valor, like himself, he added.

“I have no less than 20 Medals of Valor. I deserve a spot promotion under R.A. 8551. The law says that it has a retroactive effect. Every Medal of Valor is equivalent to a one rank higher promotion. I am now a Police Superintendent, with at least five (5) Medals of Valor as mentioned by then Sec. Robredo,” he said.

“At least my rank would be Police Director General or, at the very least, Police Deputy Director,” he added.

Moreover, Dy also clarified that as of the 2nd quarter of 2014 he had formally and personally received his appointment order as Police Deputy Director General from the Office of the Regional Personnel, Resources and Management Division of the National Capital Regional Office.

‘Good faith’

In the Motion for Reconsideration that he filed, Dy emphasized that his failure to report in in Region VIII was based on good faith.

“I based my decision upon the official letter of then Sec. Robredo who had formally addressed me as Police Director General,” he added.

“I am of the belief that the dismissal order which is the subject of my motion for reconsideration is merely a form of harassment. I have with me all the records and recommendations for my promotions. Everything is barcoded, reviewed and endorsed by all concerned officers. What I am just waiting for is the implementation by the President, he said further.

“Perhaps, due to the meteoric rise in my promotion, some officers were sidestepped or overtaken by me in terms of rank. But, there is nothing wrong with my promotions since everything is the product of my very dedicated service to the organization,” he lamented.

“The Medal of Valor is a priority for any kind of promotion. My case is probably the first time in the promotional history of the institution,” he said.

Call for Pres. Duterte

Finally, Dy Jr., said he sincerely wants this report to reach the Office of President Rodrigo Roa Duterte, who, he claims, knows him very well.

”I was assigned in Davao City and worked well with him,” he said.

“I am very much aware that President Duterte is a very fair person. He knows that I have worked hard for the good of the country. That is the main reason why I was awarded several Medals of Valor. My only wish is for the President to take notice of this issue. I have dedicated more than twenty years of devoted service to our country which has afforded me the opportunity of earning said Medals of Valor,” he said.

“I sincerely hope for justice to be served on top of these controversies hounding my special promotion,” he concluded.

Dy, Jr. is the son of former Libmanan Vice Mayor Blesilda Castaneda-Dy, who said she is also lost in the dark why her son met such fate.

Mrs. Dy said that like her son, she prays that a thorough investigation will be conducted into the issue.

Avenido couple nabbed, face 47 arrest warrants

NAGA CITY—A total of 47 warrants of arrest for the crime of syndicated estafa were served against Nestor Avenido y Puerto and Maria Joy Avenido y Agnabo by the Criminal Investigation and Detection Group yesterday (April 18), Tuesday in Sto. Tomas Municipal Police Station.

The report say that prior to this, both suspects were arrested on April 14, 2017 at around 8:30 p.m. at Barangay San Antonio, Sto. Tomas, Batangas by the CIDG in Region IV-A and the Municipal Police Station of Sto. Tomas, Batangas. The arrest was based on pending warrants for the crime of syndicated estafa issued by Judge Vivencio Gregorio A. Atutubo III of RTC Branch 31 in Pili, Camarines Sur, with no bail recommended.

Meanwhile, upon being informed of the said arrest, the CIDG team from Camarines Sur led by PCI Ronnie M. Fabia, travelled to the said town to serve other pending warrants of arrest in the different RTC branches in Pili and Naga City, and the MTCC in Naga City.

The Avenido couple were served with arrest warrants for five (5) cases for violation of BP 22 issued by Judge Zenaida Najera-Bragais, of Branch 3 of MTCC here.

Presiding Judge Bernard Beltran of RTC Branch 23 in Naga City also issued one (1) warrant of arrest.

Also pending with RTC Branch 31, in Pili, Camarines Sur were 20 warrants of arrest, all issued by Presiding Judge Vivencio Gregorio G. Atutubo III.

In RTC Branch 32, in Pili, Camarines Sur, where Judge Vivencio Gregorio G. Atutubo III is the pairing judge, he had also issued a total of 9 warrants of arrest against the Avenidos.

In RTC Branch 33, also in Pili, Camarines Sur, Judge Erwin Virgilio P. Ferrer issued 11 warrants of arrest, with no bail recommended.

The arresting officers said that the accused couple will be surrendered to the different courts where thay will be presented to the Presiding Judges, once they arrive here in Camarines Sur.

The examination was conducted on April 10 and 11 in the cities of Manila, Baguio, Cagayan de Oro, Cebu, Davao, Iloilo, Legaspi, Pagadian, Tacloban, Tuguegarao and Zamboanga.

497 student-athletes power Bicol in Palarong Pambansa '17

LEGASPI CITY 4/18/17 (Bicol Standard) – Four hundred and ninety seven (497) student-athletes from the Bicol Region will see action during the Palarong Pambansa on April 23 to 29 in the province of Antique.

Also included in the delegation are 126 coaches, assistant coaches and chaperons, who will compose the Team Bicol.

A Bicol Standard source said that security is tight owing to the incidents that happened in Bohol last week.

The entire delegation is billeted at San Pedro Elementary School and San Pedro High School in San Jose de Buenavista, Antique.

The Bicolano student–athletes were selected from the thirteen Schools Divisions of the Region in the said regional group.

Meanwhile, it was also learned that 456 athletes will compete in the regular events, 35 in special events, and six in the demonstrative competitions.

The Division of of Camarines Sur, the 2017 Palarong Bicol champion comprised the majority of the players, with 163 athletes.

Catanduanes Schools District and Sorsogon City Schools District both have at least 6 delegates each.

The total budget for this year’s Bicol delegates is Php10 million provided by the central office of the Department of Education and an additional Php 850,000.00 that was raised from the Bicol Fun Run.

Malinao mayor suspended for 90 days

MALINAO, Albay, 4/18/17 — Vice Mayor Sheryl Capus is expected to assume office as acting town mayor after Malinao Mayor Avelino Ceriola was meted a three-month suspension by the sixth division of the Sandiganbayan.

Ceriola was charged graft and corruption stemming from the construction of a cockpit arena in the town, said a decision issued on April 4.

He said the 90-day suspension order, a copy of which he received on Tuesday morning, was for violation of Republic Act 3019 or the Anti-Graft and Corrupt Practices Act.

He said the three-page order directed him to cease and desist from further performing and/or exercising the functions, duties and privileges of his position as municipal mayor.

The decision was signed by Associate Justice Rodolfo A. Ponferrada as chairperson and concurred by Associate Justices Oscar Herrera Jr. and Karl B. Miranda.

The case, which was filed against Ceriola by municipal councilor Irene Fajut in 2013 during his first term as municipal mayor, was about the construction of the Malinao cockpit arena in Barangay Balading.

Fajut had accused Ceriola of conflict of interest and said that the cockpit’s construction did not have any business permit.

Ceriola said he would file a motion for reconsideration in the Sandiganbayan as soon as possible but will continue to fulfill his duties as town mayor until stopped by the Department of Interior and Local Government. (With report from PNA)

Threats hound Catanduanes Board Members

VIRAC, Catanduanes— Provincial Board Members Giovanni A. Balmadrid and Arnel Turado announced yesterday that they received death threats on Easter Sunday from an unidentified text message sender.

In a press conference yesterday, Balmadrid read the content of the text message he received: “balmadrid sobra man isog mo dai k ng bga pili huway lang sa mga bga pasar mong reso igwa kng na apektuhan,saday p mga aki mo baad maapura buhay mo.”

Turado, for his part, said the message he received reads: “mayad n hapon pbm baging sobra na ang pkialam m,pati huwes bga dali mo hinay lang baad dai mag awat buhay mo.”

Balmadrid said the text message made him fear for his four children, in case something does happen to him.

“I consider this as a death threat kasi sa tono ng text nya, may capability sya na mangpatay ng tao. Hindi natin pwedeng isawalangbahala ito,” Turado said.

They said they have no idea who the sender of the threats could be.

“Wala akong kaaway,” Balmadrid stressed.


Due to the mention of the resolution and the word “huwes,” they suspect the sender could have been affected by the resolution they passed concerning Judge Lelu Contreras.

“But we are not implicating names,” Balmadrid said.

Meanwhile, Turado clarified, “I do not say and I do not think that judge could do this, hindi to kayang gawin ng judge gaya ni Judge Contreras. I still respect Judge, being our RTC judge, and I would assure that she could not do this.”

Turado said he already had the incident recorded in the police blotter. Balmadrid added that he plans to do the same.

Asked what he will do about the incident, Balmadrid said: “Mag-ingat na lang siguro. Kung ano mang mangyari samin at least alam ng publiko. Anyway, this is part of our job. Mahal ko ang trabaho ko. Mahal ko ang mga taga Catanduanes.”

“We will still do our job,” Turado said.

Judge Lelu's reaction

Meantime, in a separate media interview, Judge Lelu Contreras said she was surprised about the report that the two Board Members allegedly received threats.

She pointed out: “Bakong unanimously approved so resolution laban sako. An hapot, tano ta sindang 2 lang an allegedly threatened and not all of them who approved it.”

Asked about her reaction on the claim of the Board Members that they were the proponents of the resolution, the judge said: “Gusto nindang sabihon nag-research pa so nagpapadara sainda nin death threats kaya naaraman na sindang 2 an proponents? Councilor Pimentel assumes as Vice Mayor of Vinzons

VINZONS, Camarines Norte 4/18/17 (Bicol Standard) – Municipal Councilor Joaquin Emmanuel “Jay” Pimentel has assumed office as acting vice mayor due to the suspension of vice mayor Ligaya Heraldo, who was found guilty of an administrative charge for abuse of authority.

Interviewed by the media, Pimentel, who is also the President of the Philippine Councilor's League - Camarines Norte Chapter and thus an ex-officio member of the Provincial Board, said that it has never been his ambition to be vice mayor or mayor of this town.

Heraldo, it will be recalled, was imposed a penalty of two months suspension from office, due to the said administrative charge.

The suspension order, which was approved by the Provincial Board, was implemented last week by Camarines Norte Gov. Edgardo Tallado.

The suspension from office of vice mayor Heraldo stemmed from the administrative complaint filed by Liga ng mga Barangay President Jose Segundo, Barangay Chairman Manuel Obusan and former Mayor Oliver Ferrer.

Pimentel also clarified that his assumption as vice mayor does not mean that he is abandoning his seat as an ex-officio member of the Provincial Board, since his tenure as acting vice mayor is only for a period of two months.

Meanwhile, he explained that there are a lot of things to be done, hence he will only focus in giving better service to the people, instead of thinking of politics, he said.
