DPWH DE wants Atty. Rodulfo disbarred

NAGA CITY, 12/1/16 (Bicol Standard) – A self-proclaimed crusader and whistleblower in the Regional Office of the Department of Public Works and Highways (DPWH) is now the subject of an administrative complaint for disbarment filed with the Supreme Court, due to his alleged violations of his oath of office as a lawyer.

In an 11-page complaint, Elmer R. Redrico, OIC District Engineer of Catanduanes, said that respondent lawyer Oliver Rodulfo had transgressed at least six canon rules that carry the stiff penalty of disbarment.

Atty. Rodulfo, Chief of the Legal Office of the DPWH Regional Office V is allegedly liable for Gross Ignorance of the Law, Conflict of Interest, Violation of the Lawyer’s Oath and Code of Professional Responsibility, Redrico said.

In the said complainant, Redrico narrated some circumstances that would establish the alleged illegal and irregular acts.

Redrico points out to a certain incident that resulted in the post disqualification of JD Construction, one of the qualified contractors that participated in the bidding of a DPWH project in the province of Catanduanes.

The complainant narrated that it came to his knowledge that Atty. Rodulfo, head of the legal section of the DPWH V, was personally responsible for the preparation of the motion for reconsideration for and in behalf of the post disqualified JD Construction.

The motion for reconsideration was denied by the Bids and Award Committee (BAC).

Upon receipt of the denial, the company filed a protest against said decision of the BAC. He later learned that Atty. Rodulfo was again responsible for the preparation of the said motion, Redrico said.

Meanwhile, subsequent to the incident, he was surprised when Atty. Rodulfo approached him and offered legal assistance in resolving the protest lodged by JD Construction.

Without hesitation, the complainant said he acceded to the help offered by Atty. Rodulfo, since he is the Legal Officer of the DPWH V and at one time, he served as his lawyer in one of the complaints filed against him at the Office of the Ombudsman, he said.

At the behest of Atty. Rodulfo, he was persuaded to sign a Resolution that set aside the post disqualification of JD Construction.

After a careful perusal and review of the resolution, however, Redrico found out that there was a glaring violation of the rules, and that the post disqualification of JD Construction was meritorious. After consultation with the Regional Office, he rectified said erroneous Resolution.

“In short, Atty. Rodulfo who is the legal officer of DPWH ROV is acting as lawyer of a private firm (JD Construction) transacting with the very office of the DPWH,” the complaint stated.

The same respondent also acted with conflict of interest being the business partner of the construction firm, Redrico added.

The complainant prays that Atty. Rodulfo be disbarred for his unlawful, illegal and gross misconduct which constitutes violations of his lawyer’s oath and code of professional responsibility.

The administrative complaint was filed with the Office of the Bar Confidant of the Supreme Court last October 24.

BICOL STANDARD tried to reach Atty. Rodulfo for his comments regarding the complaint but was told that the lawyer is out of the country.
