Comelec therein ordered the proclamation of Abonal as the 2nd Member of the Sangguniang Panlalawigan (SP) for the Second District of this province, after the poll body cancelled Hernadez’ certificate of candidacy.
In the 3-page Memorandum, dated Feb. 25 2015, Secretary Mar Roxas, through Undersecretary Austere A. Panadero, commanded Dir. Elouisa T. Pastor, Officer-in-charge of DILG-5 to “cause the implementation of the Writ of Execution in coordination with the COMELEC-Region V Election Director.”
Meanwhile, Abonal has not yet been officially recognized by the SP since his proclamation on Feb. 20.
It will be recalled that during the provincial legislative council’s regular session on March 10, the SP skipped the roll call.
The legislative council has likewise ignored the plea of the Board Member to participate as its member in today’s session.
Instead, Vice-Governor Fortunato “Ato” Peña referred the matter to council’s Committee on Rules, saying that it would be wise to defer Abonal’s recognition pending the Supreme Court’s resolution of the Petition for Certiorari with Prayer for the issuance of a Temporary Restraining Order filed by Hernandez.
This action was slammed by Abonal who said: “there is no need to table the writ of execution for the committee has nothing to deliberate.”
Meanwhile, Abonal told BICOL STANDARD that he has already filed with Comelec a motion to declare the SP officials in contempt for refusing to officially recognize him, notwithstanding its receipt of the copy of the writ of execution.
He has likewise submitted a letter to the DILG requesting the state bureau to direct the SP, through the Vice-Governor, to comply with the writ of execution.—BICOLSTANDARD.COM
