Substance seized from brgy. chief tests positive for shabu

Camatoy was placed under arrest at about 2:07 AM of February 3, 2015 by PO3 Marwin B De Vera.
Confimatory tests yield positive resultAccording to the official progress report furnished to BICOL STANDARD, the three pieces of medium size heat-sealed transparent plastic sachet containing white crystalline granules, marked JLT -1 8:06 PM, JLT-8A
8:30 PM and JLT-8B 8:30 PM, all tested positive for methamphetamine hydrochloride (“shabu”).
The seized sachets have net weights of 0.251 gram, 0.242 gram and 0.233 gram, respectively with a total gross weight of 0.726 gram.
In addition, the improvised tooter, which was marked JLT-12 9:26 PM, also tested positive for the presence of methamphetamine hydrochloride or “shabu.”
ArrestIt will be recalled that on February 2, 2015, at around 7:48 PM, a team from the Viga Municipal Police Station(MPS), in cooperation with personnel from the San Miguel Police Station, implemented the Search Warrant Number. 2015-8 issued and signed by Hon. Lelu P. Contreras, Executive Judge, RTC Virac, this province on 27 January 27, 2015 against the barangay chief for violation of R.A. 9165.
The Viga MPS team, led by Acting Chief of Police PSI Edgar Ebuenga Azotea, was composed of the following: Searching Team Leader PO3 Marwin B De Vera-IOC/arresting Officer PO3 Joseph L. Tupue-Searcher, PO3 George V. Grebialde-Recorder, PO2 Jordan T Teope, Photographer, and PO2 Quirico M. Ortinero, Security Team Leader.
Recovered from Camatoy’s possession were one piece medium size heat-sealed transparent plastic sachet containing white crystalline granules believed to be shabu, b) one medium-size
heat-sealed transparent plastic sachet containing white crystalline granules believed to be shabu; and c) one medium sized heat-sealed transparent plastic sachet containing white crystalline granules believed to be shabu.
Non-drug items including a white jacket, a cellphone, a lighter, and three rings, cash were also confiscated.
The search and seizure operation was witnessed by Janelyn Rima who served as the media representative, Rudy Templonuevo, DOJ representative, and Brgy Councilors Domingo T. Publico and Ricky T.
Charges filed vs brgy. chiefCases for violation of Sec. 11 (Possession of Illegal Drugs), Sec.12 ( Possession of Drug Paraphernalia) and Sec. 6 (Maintenance of Drug Den), both for violation of of RA 9165 ( Comprehensive Dangerous Drug Act of 2002) were filed by Viga MPS before the Provincial Prosecutors Office, Virac through inquest proceedings.
The cases were docketed under NPS NR. V-II-INQ-15B-00022, NPS NR. V-II .- INQ-15B-00023 and NR. V-II.- INQ-15B-00024, respectively.
Meanwhile, suspect voluntarily waived his right under Article 125 of the Revised Penal Code of the Philippines, with the assistance of his counsel Atty. Merlin I. Abada of Public Attorney Office.
An order in connection with the said waiver was subsequently issued by Eugenio L. Abion, provincial prosecutor, dated 4 February, 2015, placing the aforesaid suspect under the custody of Viga MPS, pending the preliminary investigation which is being conducted by the said office. —BICOLSTANDARD.COM
