Fighting cock intentionally injured by owner to ensure win

MASBATE—A cockfighting aficionado was arrested by fellow cockers when it was discovered that he intentionally injured the left leg of his fighting cock to ensure outright defeat.

In the outrage of bettors, the suspect, Elvis Pillejera y Atendido, was subjected to citizen’s arrest and  brought to the police station to face criminal charges for Swindling.

This incident happened on June 19 at around 4:30 in the afternoon at Gallera de Baleno Cockpit Arena, Barangay Potoson, Baleno.

The investigation shows that the cockers noticed that the left leg of the suspect’s fighting cock was already damaged due to an intentional injury prior to the fight.

Bettors alleged that the suspect’s fighting cock was finding difficulty in movement due to muscle or nerve function damage.

The controversy was so pronounced because the cockfight involves a bet amounting to P52,800.
Specifically, police investigators are looking at the provisions of Article 315 of the Revised Penal Code (Estafa) as the law that the suspect could have violated.

3 arrested for trafficking 14-year-old in Camaligan

CAMALIGAN, CAMARINES SUR—Three persons are now facing criminal charges for violation of RA 10364 (Expanded Anti-trafficking in Persons Act 2012) after they were arrested in an entrapment operation conducted by the Philippine National Police (PNP).

The suspects were identified as Daisy “Miky” Esquivar, 38 years old, single, and a resident of Doña Clara, Concepcion Grande, Naga City; Arnel Hinagpis y Mendoza, 43 years old, married, of B2-L3, Pacol, Naga City; and Joan Aguilar y Tejero, 20 years old, of Puro, Canaman, Camarines Sur.

Immediately, the case, which was docketed under Inquest No V-10-14C-11419, was filed against them at the Provincial Prosecutor’s Office, in Naga City.

The report claims that a 14 year old girl, Myla (not her real name), received text messages and calls in her cell phone, informing  her that the above-mentioned persons would fetch her at about 11:00 in the evening , at Barangay San Mateo, this town.

This incident was made known to her mother, who listened to the conversation of the suspects and the victim, when the cell phone was put on loud speaker mode.

It was at this instance, when the mother sought the help of the barangay officials of Marupit including several police officers, who could help in the entrapment the suspects.

The suspects were arrested while on board a white car bearing the plate number TWH 350.

Meanwhile, it was also revealed that prior to this, Myla was already traded last June 3 in Naga City.

Myla confirmed that she was promised to be paid P1,500 for one sexual contact.

But, she was short changed when she was only given P1,000, she added.

Meanwhile, in an interview over DWNX, the mother of Myla admitted that this is not the first time that her daughter was sexually abused. She was already raped, the mother explained.

The victim’s mother confirmed that the person suspect of raping Myla is detained at the Bureau of Jail Management District Jail in Naga City.

Furthermore, Myla is now out of school, after she suffered the traumatic experience, resulting from her being sexually abused. –BICOLSTANDARD.COM

Trike driver killed in Milagros, Masbate

MILAGROS, MASBATE – Police authorities are still conducting an investigation in connection with the shooting incident that claimed the life a tricycle driver at Barangay Cayabon here.

The victim was identified as Ardee Fuentes alias “Blotche,” a resident of the said barangay.

The initial report gathered by the police investigators reveal that the victim was driving his tricycle along the National Highway when he was fired upon by two unidentified persons.

The suspects were riding a motorcycle with no plate number.

The report says that the gunmen pumped several bullets into the body of Fuentes, which resulted in his instant death.

Several empty shells fired from the caliber .45 pistol were recovered in the scene of the crime.

The suspects fled towards the direction of Masbate City after the incident.

Police authorities are still gathering information from the witnesses, the report added.

Pastor arrested in Daet for kidnapping, rape

DAET, CAMARINES NORTE – Two criminal complaints for the violation of Article 270 of the Revised Penal Code (Kidnapping and Failure to Return a Minor) and Republic Act 8353 (The Anti-Rape Law of 1997) have been filed against a pastor who allegedly kidnapped two students.

The complaints were filed by personnel of the Anti-Kidnapping Group (AKG) of Camp Crame, Quezon City through inquest proceeding in the Antipolo City Prosecution Office.

The suspect was identified as Jose Sumbillo y Gonzales, 44 years old, and a resident of Sitio Daang Bakal, Antipolo City.

According to the victims, they were kidnapped from their residence in Sitio Daang Bakal, Antipolo City sometime in May 2014. They were taken to Candaba, Pampanga where they stayed for some time. On June 5, they were brought to Daet.

On June 12, the Office of Anti-Kidnapping Group in Camp Crame received information about the alleged kidnapping of two minors who were believed to be taken somewhere in Daet.

The suspect purportedly tried to extort money from the father of one of the victims. He requested that the money be sent via LBC.

Meanwhile, a special team composed of PNP personnel was created to track the whereabouts of the suspect and to rescue the victims. Said team conducted a surveillance of all LBC outlets within the town of Daet, where the suspect was expected to receive the money.

The suspect was arrested on June 14 at the LBC outlet at Vinzons Avenue, Daet, after he claimed the amount of P700, which was sent by the father of one of the victims.

The police confiscated from the suspect the transaction receipt as well as two Cherry Mobile cellphones.

The suspect revealed to the authorities that he brought the victims to the El Shaddai Compound in Ricafrente St., Barangay Gubat, Daet.

The same team, together with Mr. Emmanuel Ebona, a social worker and a staff member of the Daet Municipal Social Welfare and Development Office (MSWDO), and PO3 Angelita Avila Caña of the Women and Children Protection Desk, thus proceeded to said address.

There, they found the two victims, along with the suspect’s three-year-old son.

CA junks injunction vs Casureco II over power rate hike

NAGA CITY—The 5th Division of the Court of Appeals has reversed and set aside the decision of Branch 33 of the Regional Trial Court (RTC) in Pili, Camarines Sur. The said decision permanently enjoined Camarines  Sur II Electric Cooperative (Casureco II) from demanding and collecting payments from its member-consumers or end users.

“Accordingly, the Petition for Injunction filed by Genoviva Dimaiwat, Josephine Leonidas and Evangeline Laurente is ordered DISMISSED and the Permanent Injunction issued by the trial court is hereby DISSOLVED,” according to the dispositive portion of the decision, promulgated June 14, 2014.

It will be recalled that last January, Presiding Judge Marvel Clavecilla of RTC Branch 33 in Pili, reminded the cooperative’s Board of Directors and the General Manager about the permanent injunction which he issued against Casureco II.

In the said RTC decision, coop officials were “permanently enjoined from demanding and collecting payments from the member-consumers  or end-users of Casureco II for the electric consumption last April 2010 and demandable last May 2010 UNLESS the power billing is based on the March 2010 power rate of P4.8939 per kilowatt hour, less the penalty charge imposable for the duration of the TRO as subsequent to March 25, 2010, the expiry date of the extension by APRI of its power supply agreement with CASURECO II, the latter directly purchased its 100% power rates from WESM (Wholesale Electricity Spot Market) at excessively higher rates and without proper notice and hearing.”

The RTC decision was question by the coop board, which raised the following issues.

“First, the Regional Trial Court committed an irreversible error in holding that it has jurisdiction over the subject matter of the petition.

Second, assuming that the Regional Trial Court has jurisdiction over the subject matter of the petition, it committed an error in holding that the petition can be classified as a class suit even if all types of member-consumers were not represented in the petition.”

The Court of Appeals held that the appeal of the electric cooperative, represented by then General Manager Jane Barrameda and then Board President Atty. Nixon Tabora, is meritorious.

“The trial court had erroneously arrogated upon itself the jurisdiction to pass upon the issue of whether or not Casureco II is authorized to collect unannounced increase in the Generation Systems Charge to its member-consumers given the fact that authority to resolve this controversy, the jurisdiction of which is initially lodged with the administrative body of special competence, is the ERC,” said the CA.

Meanwhile, as a result of the RTC decision, the electric cooperative allegedly suffered a tremendous amount of losses in its operation.

While the RTC ordered the electric cooperative to collect P8.42 per kilowatt hour, the coop computed the proper rate at P15.39 per kilowatt hour.

The members of the Board as well as the management, despite the injunctive writ, pushed through with the P15.39 per kilowatt hour rate. This caught the ire of the court, since it violates the injunctive writ. At that point, the presiding judge threatened to hold theBoard of Directors as well as coop officials liable for indirect contempt. This, the court articulated, would happen if the said officials would continue imposing the much higher electricity rate.

Atty. Vicky Briones, the NEA Project Supervisor assigned to Casureco II, confirmed to BICOL STANDARD in an interview that as of March 2014, the coop has suffered losses amounting to at least P500 million, because of its inability to collect the proper rate.

Said losses will still substantially increase if the losses for the months of April, May and June are factored in.

Atty. Briones added that she will meet with the members of the management committee and the Board to discuss the issue.

Meanwhile, she explained that while she is aware of the fact that the CA decision is not yet final, she would already convince the petitioners not to prolong the legal process, as it is hurting the financial status of the coop.

Miss Pinyasan candidate cleared of contest eligibility controversy

CAMARINES NORTE — A candidate for the Miss Pinyasan 2014 beauty pageant was almost robbed of the chance to vie for the title after figuring in a controversy involving her place of birth.

Fellow candidates and their parents reportedly wrote a protest letter alleging that candidate number 10 Princess Cecilio is not from the province of Camarines Norte.

The letter reached Francisco Elevado, who reported the matter on his Facebook account.

The same letter was brought to the attention of Municipal Tourism Officer Marco Paulo Delfinado, who conducted an investigation to verify the allegation.

Masbate PD wants Monreal police out of Mayor Espiloy’s control and supervision

This was revealed to BICOL STANDARD by PNP Regional Information Officer P/Insp Malou Calubaquib, in a text message this morning.

Calubaquib said that the Monreal police force is housed in a small hut which serves as their temporary office.

This situation ensued after police officers decided to abandon the LGU building after a serious misunderstanding with Monreal town Mayor Ben Espiloy.

It will be recalled that this controversy erupted two weeks ago when the local police decided to shave the hair on their heads to protest the unfair treatment made by the town chief executive.

Allegedly, the mayor even scolded them when they refused not accommodate his request to allow a detention prisoner to use an air-conditioned room inside the PNP office.

The detention prisoner is facing a criminal charge for violating the Comprehensive Dangerous Drugs Act.

There are also allegations that the detention prisoner is a friend and close ally of Mayor Espiloy, hence his request that he be given special treatment, the report added.

The refusal made by the PNP to follow the mayor’s order immediately triggered the decision of the Local Chief Executive to order the disconnection of the power supply to the police office.

“As of this morning, the situation is still the same,” Calubaquib said in a text message to BICOL STANDARD.

“We are just waiting for the decision of the National Police Commission (NAPOLCOM) to rule upon the petition of Masbate Provincial Director P/Supt. Karl Michael Reyes.

P/Sr Supt. Reyes requested the NAPOLCOM that the local chief executive of Monreal be stripped of his authority to have control and supervision of the police, Calubaquib said.

Meanwhile, the Regional Office of Philippine National Police has provided an augmentation force to avert any untoward incidents that may arise from the rather volatile situation, she explained.

As this developed, the local police in Monreal could not be persuaded to return to the office which they used to occupy before this controversy.

“There will be demoralization upon our ranks if we return to the office which we vacated,” said Police Sr/Inspector Ignacio Suarilla.

Son of Naga City councilor collared in entrapment operation

Joseph Ivan Anthony Tuazon y Ballares was arrested by the group of P/Supt Eymard Zaldivar Gomez, together with the members of the Detective Management Unit of the Naga City Police Office (NCPO) in an entrapment operation.

The police report said that at around 3:00 pm yesterday, former City Councilor Raoul Rosales received a telephone call from Ning Salazar, an employee of E-mall.

Salazar inquired if Rosales is aware of the letter that is being shown to E-mall that requests financial support for Mrs. Jenna Rosales, wife of Raoul, who the letter said, is sick with cancer and needs financial assistance.
The police records show that Joseph Ivan Anthony Tuazon, had with him a letter purportedly signed by Raoul Rosales and City Councilor Jose Perez, whom he made to appear to have endorsed the same.

The solicitation letter is printed using the Letter head of the Office of the Vice Mayor of Naga City.

In the investigation, it was found out that both signatures of Rosales and Perez were fake.

Upon this incident, the Intelligence section of the NCPO planned an entrapment operation against Tuazon.

During the entrapment, marked money amounting to P2,000, with serial number GN059823 and HG910090, that was used by the intelligence agents, was found in Tuazon’s possession.

The suspect is now detained at the NCPO. He will be charged with violation of the law on Forgery and other deceits, according to the police.

The charge is now being prepared to be filed with the City Prosecutor’s Office.

Meanwhile, over DWNX, the suspect admitted that he has been using illegal drugs for the past three years. He further stated that it is his intention to undergo drug rehabilitation.

Furthermore, the NCPO confirmed that this is not the first time that the name of the suspect figured in illegal acts.

His name also came up in an investigation that involved the collection of money from persons who are applying for their guns to be licensed. But, in several instances, after having collected the money from his clients, Tuazon would no longer show up, and no gun license is produced.

On the part of City Councilor Tuazon, he said that while he is very sorry for what happened to his son, he is at the same time thankful that he was already apprehended for his illegal acts.

The suspect has been a casual employee of the Sangguniang Panlungsod of Naga for past 15 years. He is assigned in the office of his father, Councilor Tuazon.

The garlic story

Although the lowly garlic is believed to have supernatural powers against vampires and witches, it appears to be powerless in warding off price hikes. In supermarkets across the nation, the culinary staple in Filipino kitchens has reached a price of P300 per kilo. Meanwhile, the prices of other basic commodities like rice, ginger, and sugar, are also skyrocketing.

But while the spike in prices is surprising, what is even more shocking is this: no one seems to be able to give a definite explanation on why the situation is even happening.

Some reports say that there is price manipulation or hoarding. Others argue that it could be due to the lessened number of colorum buses that make transporting goods expensive and difficult. Still some claim that the cost is affected by the global price of the commodity, while others theorize that a sudden rise in the population could have strained the supply.

If the confusion on the garlic issue is not enough to make one’s head spin, perhaps this would: the administration, which has made it its trademark to pass the blame on anything other than itself, is not doing enough to even remotely solve the problem. Their weapon of choice against the price spike happens to be rolling stores, which supposedly sell cheaper garlic. However, as they are only available in selected parts of Metro Manila, they cannot possibly address a problem that the entire nation is facing.

Of course, with the upcoming State of the Nation address, the government chooses to focus on the arrest of three senators, while protecting the President’s allies who are facing the same accusations. After all, it needs to have a semblance of having actually achieved something big—something that may distract people from its promise last year that the supply of basic commodities is adequate, enough even, for export.

The government, however, cannot keep playing deaf to the cries of hungry Filipinos. Unfortunately for them, it may be more difficult to silence rumbling stomachs than to quell protests against the DAP and PDAF scams.

CCW Bicol Chair wants to pursue AHECS query

NAGA CITY – There seems to be a brewing misunderstanding between CCW Bicol Chairman Diego Magpantay, Jr., and CCW Albay Provincial Chapter head Evangeline G. Marinay that could derail the investigation of the alleged anomalies in the implementation of the P700 million scholarship program in Albay.

In an interview by BICOL STANDARD yesterday, Magpantay said that Marinay could not perform her task as representative of the Citizens Crime Watch, because she is perceived to be covering up the alleged anomalies of several high-ranking officials of the province.

“In order to erase doubts, she (Marinay) must not even be part of the investigating committee. As CCW Albay chair, she has not initiated any move to quell or denounce many reported anomalies involving officials in Albay province and other government agencies. She was tagged by local media in Albay as an alleged ally of Governor Salceda,” Magpantay lamented.

“We could not have a through and impartial audit of Albay Higher Education Contributing System (AHECS) anomalies, if a member of the investigation group has, at the outset, already exonerated the persons who are to be investigated,” Magpantay emphasized.

Magpantay told BICOL STANDARD that last week an audit team was organized and tasked to scrutinize the documents involving the P700 million AHECS program.

Yesterday, however, he was caught by surprise when he went to Albay, only to be informed that the investigation was already concluded.

According to Magpantay, the investigation could not be completed in a very short span of time because there are voluminous documents that must be scrutinized to have a full dress investigation.

Earlier, CCW Secretary General Carlo Magno Batalla also announced that, indeed, an audit team would be organized to conduct a thorough inventory and investigation of the AHECS program.

The group would be headed by Ret. Regional Trial Court Judge Amado Calderon and three other members.

On the other hand, Atty. Pete “Bitay” Principe, President of the Philippine Trial Lawyers Association, would serve as the legal consultant.

Magpantay clarified that as Regional Chairman of CCW, he had received numerous complaints from Albay regarding the AHECS program of the provincial government.

It is just proper that the people must be made fully aware of the transactions. Further, he said, the audit that would be conducted by CCW would spell out if there were violations of the Anti-Graft and Corrupt Practices Act.

Prior to this, CCW said that Provincial Administrator Eriberto Lero Berces III confirmed in a letter addressed to CCW Chairman Jose Malvar Villegas, Jr. that Governor Joey Salceda also approved the audit.

Meanwhile, Magpantay explained that he would not rest until this issue is properly addressed. He, however, told BICOL STANDARD that he would discuss this matter with the ranking officials of CCW to make them aware of the situation. – BICOLSTANDARD.COM

Acting Gov. Escudero seeks support of SP, LGU officials

SORSOGON CITY—While admitting that he is not in optimal physical condition, Acting Governor Antonio “Kruni” H. Escudero assured Sorsoganons that he is mentally well. In his letter to Sorsoganons, Escudero said that he assumed the position of Acting Governor in view of the fact that Governor Raul Lee is serving his suspension.

In the same letter, Escudero sought the full support of the members of the Sangguniang Panlalawigan, other provincial officials and employees to ensure the smooth delivery of services to the people.

Acting Governor Escudero said that he hopes that everything will be in order once Gov. Lee returns to office after serving his suspension.

It will be recalled that Lee voluntarily submitted himself to the preventive suspensionorder, based on a decision by the Sandiganbayan. Said decision was to be implemented by the Department of Interior and Local Government (DILG).

29 Bicol PNP officials sacked

LEGAZPI CITY – Chief Superintendent Victor P. Deona, Police Regional Office 5 (PRO5) director, made good his warning that police officers who fail to perform well will be relieved from their post and subjected to a refresher course.

Last June 13, twenty-nine police officers in the region were sacked. Of these, three are from the province of Albay, three from Camarines Norte, three from Camarines Sur, three from Catanduanes, two from Masbate, six from Sorsogon, and nine from the Regional Police Holding Administrative Unit (RPHAU).

Deona did not identify the police officers. He only revealed that 28 of them are chiefs of police, while one is an intelligence officer. He said that once they have completed retraining, they will be given a chance to be reassigned. However, they will not be allowed to return to their old posts. If they fail thrice, Deona clarified, they will have to look for other jobs.

The police officers were evaluated on their performance based on three indicators: crime prevention, crime solution, and law enforcement.
